Terms of Use

These Terms of Use ("Terms") are a legally binding agreement between Mind Reveal ("we," "us," "our") and each person who accesses or uses our website, web application, and virtual reality research game (collectively, the "Service"). By creating an account, accessing, or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Purpose; Research-Only Status

1.1 Research use only. The Service is provided solely for research and product-development purposes to study gameplay behaviour and device-motion metrics. It is not a medical service, not a diagnostic tool, and is not intended to diagnose, treat, cure, or prevent any disease or condition. Any outputs, scores, or reports generated now or in the future are informational only and may assist a qualified healthcare professional, who remains solely responsible for any clinical judgment or decision.

1.2 No medical device claim. The Service is not presented or placed on the market as a medical device and is not certified/approved by the MHRA or any other regulator. We make no claims of clinical performance.

1.3 Beta/experimental. The Service is in beta and may contain errors or change, suspend, or cease without notice.

2. Eligibility and Accounts

2.1 Age. You must be 18+ to participate. If you are 13–17, a parent/guardian must review and accept these Terms and directly supervise participation. The Service is not for children under 13.

2.2 Accurate information. You agree to provide accurate information and keep it current.

2.3 Account security. You are responsible for all activities under your account and for keeping credentials secure.

3. Research Participation & Consent

3.1 What we collect. During gameplay we collect interaction data (e.g., task performance, reaction times, errors), headset/controller motion and orientation, device/technical telemetry, and optional survey responses.

3.2 How we use it. We use your data to conduct research, improve the Service, develop analytics and AI models, and create aggregate statistics.

3.3 Voluntary participation. Participation is voluntary. You may stop at any time by exiting the game; see Section 11 for data rights.

3.4 Future outputs. If you request a future "participant report," it will be for information only and not a diagnosis. You must seek independent advice from a qualified healthcare professional before relying on any output.

3.5 Compensation & costs. Unless we state otherwise in writing, there is no compensation for participation and you are responsible for your own costs (e.g., internet/data).

Note: We may provide a separate Participant Information Sheet & Research Consent tailored to our study protocol; if there is any conflict, those documents control for research-ethics matters.

4. Health & Safety – VR Use

4.1 Consult your doctor before use if you are pregnant, have a history of seizures/epilepsy, photosensitivity, motion sickness/vertigo, cardiovascular, neurological, psychiatric, or other conditions that could be affected by VR.

4.2 Set-up. Use only in a safe, open area free of obstacles; secure loose objects; use wrist straps; remain aware of surroundings.

4.3 Stop immediately if you feel unwell (e.g., dizziness, nausea, disorientation, eye strain, headache) or experience any discomfort.

4.4 No high-risk activity immediately after intense sessions (e.g., driving) until symptoms, if any, resolve.

4.5 Supervision of minors is required where permitted by Section 2.1.

5. No Medical or Professional Advice

The Service and any outputs or communications are not medical or professional advice and are not a substitute for advice from a qualified healthcare professional. If you have a medical emergency, call your local emergency number immediately.

6. Acceptable Use

You agree not to: (a) interfere with or disrupt the Service; (b) circumvent security or access controls; (c) reverse engineer, decompile, or attempt to derive source code except as permitted by law; (d) use the Service to train competing models/services without our written consent; (e) upload unlawful, infringing, or harmful content; (f) use the Service in violation of applicable law, including export controls and sanctions.

7. Intellectual Property; Feedback

7.1 Our IP. We and our licensors own all rights in the Service and its content, excluding your personal data.

7.2 Limited licence. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for research participation in accordance with these Terms.

7.3 Feedback. If you submit feedback, you grant us a worldwide, perpetual, irrevocable, royalty-free licence to use it without restriction.

8. AI Features and Model Training

8.1 Model training. We may use de-identified and/or aggregated data derived from your participation to research, develop, and improve algorithms and models.

8.2 No individual inferences provided. Unless expressly stated, we do not provide individualized predictions or risk scores; any future report remains informational only (see Section 1).

9. Third-Party Services and Hardware

Use of third-party headsets, browsers, platforms, or networks is at your own risk and subject to their terms. We do not control third-party services and are not responsible for their acts or omissions.

10. Payment

Unless otherwise stated, participation in the research phase is free of charge. If fees are introduced later, additional terms will apply.

11. Privacy; Data Protection

11.1 Privacy Notice. Our Privacy Notice explains what personal data we collect, legal bases for processing, retention, international transfers, and your rights.

11.2 UK data protection law. We process personal data under the UK GDPR (as amended by applicable UK law) and the Data Protection Act 2018, and—where applicable—under the EU GDPR for EU residents. We will update our Privacy Notice to reflect any future reforms or guidance.

11.3 Lawful bases. Depending on the activity, we rely on consent, contract, or legitimate interests (including recognised legitimate interests for research) as appropriate, with safeguards for research processing. See our Privacy Notice for details.

11.4 Security. We implement technical and organisational measures appropriate to risk.

11.5 Your rights. Subject to law, you may have rights to access, correct, delete, or restrict processing of your personal data and to object to certain processing. Contact: privacy@mindreveal.ai.

11.6 Insurance. We maintain appropriate business insurance; this does not expand or limit liability except as required by law.

12. Warranties; Disclaimers

12.1 As-is / as-available. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

12.2 No clinical performance warranty. We make no warranty regarding clinical performance, correctness of outputs, or suitability for any medical purpose.

13. Limitation of Liability

13.1 Types of loss. TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF PROFITS; LOSS OF DATA; BUSINESS INTERRUPTION; OR COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE OR THESE TERMS.

13.2 Cap. OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED £100 (OR, IF YOU HAVE PAID FEES FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, THE AMOUNT OF FEES YOU PAID IN THAT PERIOD), WHICHEVER IS GREATER.

13.3 Non-excludable liability. Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

14. Indemnity

You agree to defend, indemnify, and hold harmless Mind Reveal and its officers, directors, employees, and agents from and against claims, damages, costs, and expenses (including reasonable legal fees) arising from your breach of these Terms, misuse of the Service, or violation of law.

15. Suspension and Termination

We may suspend or terminate access (with or without notice) if we believe you have breached these Terms, pose a risk to safety or security, or as required by law. You may stop using the Service at any time. Provisions that by their nature should survive (e.g., IP, disclaimers, liability limits) will survive termination.

16. Changes

We may update these Terms to reflect operational, legal, or regulatory changes. Material changes will be notified by posting the revised Terms with a new "Last updated" date. Continued use after changes means you accept the revised Terms.

17. Governing Law and Jurisdiction

These Terms and any dispute or claim (including non-contractual disputes or claims) are governed by the laws of England & Wales, and the courts of England & Wales have exclusive jurisdiction, except that consumers residing in the EU/EEA may bring claims in their country of residence where required by mandatory law.
